Business permit renewal when your city's form is not here

This page is for a business owner whose city or municipality is not among the few whose permit form PhilForms fills, such as a sari-sari store in Lipa, Batangas. At the end you will know what the national law says about renewal dates, where to get your own city's form, and what to ask the permits office.

PhilForms fills six cities' forms. Every other city or municipality has its own form and its own ordinance: get the form from your city's Business Permits and Licensing Office (BPLO; in Lipa, the City Permits and Licensing Office) or its website. PhilForms is not affiliated with any LGU.

The cities whose form PhilForms fills

City · Form; Quezon City · Unified business permit application; Makati · Business permit application; Pasig · Unified business application; Taguig · Unified business permit application; Cebu City · Application for business permit; Iloilo City · Unified business permit application

Do not file another city's form. The law requires each city or municipality to have its own single, unified application form for new permits and renewals, available online and on paper at the office (RA 11032, section 11(a)). There is a national template, in Annex 1 of the DILG-DTI-DICT circular JMC No. 01, series of 2016, and each LGU adapts it, changing it only to ask for fewer fields (JMC 2016-01, section 4.1.2). So the forms above look alike but differ in layout and in what they ask.

The dates every city follows

These come from national law, so they apply in every city; the exact day can be set by your city's ordinance.

- Local taxes, fees and charges accrue on January 1 (Local Government Code, section 166). - They are paid within the first twenty days of January or of each later quarter, unless the Code says otherwise. The sanggunian may extend the time, without surcharge, for up to six months (section 167). - Late payment may carry a surcharge of up to 25% and interest of up to 2% a month, as the sanggunian sets (section 168). - Business permits are valid for one year, and the city may renew them within the first month of the year or on the anniversary date of issue (RA 11032, section 11(e)). - If the office does not act on a renewal within the processing time in its citizen's charter, the permit is automatically extended (RA 11032, section 10).

For the cities above, the January renewal guide goes through eBOSS and each form.

Lipa City

The City of Lipa posts its permit forms and its citizen's charter on its own website:

- The Application Form (Business Permit) is listed under the Lipa City Permits & Licensing Office on the city's downloadable forms page. - The city's Permits and Licensing page lists "Application for Renewal of Business Permits" as a simple transaction and gives the basic renewal checklist, including: barangay clearance with its official receipt, a statement of gross sales or receipts, an updated real property tax receipt, an occupational permit with CTC (4 employees or fewer) or a masterlist of employees (5 or more), the fire safety inspection certificate, the sanitary permit to operate, and an updated notarized lease contract and the lessor's mayor's permit if you rent.

Bring originals for the photocopies, as the checklist says. If something on the checklist does not fit your store, ask the office before the January rush.

Any other city: what to ask the BPLO

1. Where is the unified application form, and can I renew online? 2. Is the renewal deadline January 20, the end of January, or my anniversary date? 3. What does the renewal checklist ask from a business like mine (barangay clearance, fire safety inspection, sanitary permit, statement of gross sales)? 4. Can I pay the business tax quarterly, and has the city extended the January date this year?

Mistakes that delay a renewal

- Filling another city's form because it was online. - Bringing last year's sales figure in your head instead of a written statement of gross sales. - Waiting until the last week of January, when every office is full.

Questions

Wala ang form ng Lipa dito. Saan ako kukuha?

From the City of Lipa itself: its downloadable forms page lists the Application Form (Business Permit) under the City Permits & Licensing Office. You can also get it at that office.

Kailan ang deadline ng renewal ng business permit?

National law sets the first twenty days of January for local taxes and fees, and lets cities renew permits in the first month of the year or on the anniversary date (LGC section 167; RA 11032, section 11(e)). Your city's ordinance sets the exact day.

Pwede ko bang gamitin ang form ng Cebu o QC?

No. Each city or municipality uses its own unified form (RA 11032, section 11(a)).

Do I also need to renew my BIR or DTI registration?

The mayor's permit renewal is separate. A DTI business name lasts five years (DTI business name guide); for BIR, see micro taxpayer and the returns in the percentage tax pack.
