Kasambahay rights: contract, pay, and checking your SSS

This guide is for you, the kasambahay: yaya, cook, labandera or all-around helper. You will know what your employer (amo) must give you, how to see on your phone if your SSS, PhilHealth and Pag-IBIG are being paid, and where to go if they are not. A Tagalog version is here.

What your employer must give you

You get · When · Source; A written contract, with a signed copy for you · Before you start · RA 10361, section 11; Your wage in cash, not below your region's minimum · At least once a month · Sections 24–25; A pay slip showing what you got and every deduction · Every pay day · Section 26; 13th month pay: your basic pay for the year ÷ 12 · By December 24 · Section 25; DOLE Q&A; 5 days leave with pay · After one year of work · Section 29; SSS, PhilHealth and Pag-IBIG · After one month of work · Section 30; 8 hours of rest a day, 24 hours in a row each week · Always · Sections 20–21; Three meals a day and a safe place to sleep · Always · Section 6

If you earn less than ₱5,000 a month, your employer pays all of your SSS, PhilHealth and Pag-IBIG. From ₱5,000 you pay a share, taken from your wage (section 30). No other deduction is allowed unless you agree in writing (section 25). In Metro Manila the minimum wage is ₱7,800 a month from February 7, 2026 (NWPC, NCR).

You already have an SSS number? Do not get another

Your SS number is for life, even one from an old factory job. SSS says: do not get another number. If you lost it or forgot it, ask the nearest SSS office to look up your old one (SSS, Become a member). Two numbers delay your benefits and loans later. Give your old number to your employer for the registration. Only a person with no number at all fills the kasambahay registration form, and your employer files it.

Check on your phone if they are paying

Agency · Where to look · Source; SSS · The MySSS app or the My.SSS website: "view your monthly contributions" · SSS, MySSS app; PhilHealth · The PhilHealth Member Portal: your records and contributions · PhilHealth Online Services; Pag-IBIG · Virtual Pag-IBIG, "View Records" → savings records · Virtual Pag-IBIG

You create the account yourself with your number and an email or mobile number. If you have no email, go to an SSS, PhilHealth or Pag-IBIG office and ask them to show your record. Even if your employer did not report or pay, SSS says you are still entitled to your SSS benefits, and the employer pays the unpaid contributions with a penalty (SSS, Kasambahay).

Where to complain

- Talk to your employer first, with your pay slips. - The barangay: DOLE's model contract says a disagreement may first be settled at the barangay (DOLE Form BK-1, item 17). - DOLE: unpaid or underpaid wages go to the nearest DOLE field, provincial or regional office (DOLE Q&A, question 43; RA 10361, section 37). - Abuse or a crime: the barangay and the police. The social welfare officer rescues an abused kasambahay with the barangay (DOLE Q&A, question 49).

Questions

May luma akong SSS number. Kailangan ko bang kumuha ulit? No. Keep your old number for life. If you lost it, the SSS office looks it up for you (SSS).

Paano malaman kung hinuhulugan ako ng amo ko? Look at your contributions in the MySSS app, the PhilHealth Member Portal and Virtual Pag-IBIG, or ask at any of their offices (links in the table above).

Sino ang magbabayad ng SSS ko kung ₱4,000 lang ang sahod ko? Your employer pays all of it. You share only from ₱5,000 a month (RA 10361, section 30).

May 13th month ba ako? Yes, by December 24: your basic pay for the year divided by 12 (RA 10361, section 25).

Gusto ko mag PhilHealth, SSS at Pag-IBIG. Kasambahay ako, ano gagawin ko? After one month of work your employer registers you and pays (RA 10361, section 30).
